Terms of service

Effective date: 2 September 2026

1. About these Terms

These Terms of Service govern access to the STARDUST PHARMACY website and purchases made through our online store.

The store is operated by:

Adam Ebied, trading as STARDUST PHARMACY
Straße der Jugend 18
14974 Ludwigsfelde
Brandenburg
Germany
Email: contact@stardustpharmacy.cc
Umsatzsteuer-Identifikationsnummer gemäß § 27a UStG: DE419089615

The terms 'we', 'us' and 'our' refer to Adam Ebied, trading as STARDUST PHARMACY.

Our online store is powered by Shopify, which provides the ecommerce platform through which we offer our products. Shopify isn't the seller of products purchased from STARDUST PHARMACY.

These Terms apply together with our Return and Refund Policy, Privacy Policy, Shipping Policy and statutory Withdrawal Information.

If a provision of these Terms conflicts with mandatory consumer law, the mandatory consumer law will apply.

2. Eligibility and customer information

You must have the legal capacity required to enter into a purchase contract. If you are a minor or otherwise lack full legal capacity, you may only place an order with the permission of a parent, guardian or other authorized representative where required by law.

You must provide accurate, current and complete billing, payment, contact and delivery information.

You are responsible for checking your delivery address and order details before submitting an order. If an order is returned because you supplied an incorrect or incomplete address, we may charge reasonable reshipping costs where permitted by law.

3. Customer accounts

You may be able to create an account to manage orders and access store features.

You are responsible for keeping your account credentials confidential and for activity performed through your account. Contact us promptly if you believe your account has been accessed without authorization.

You may not sell, transfer or provide your account to another person.

We may restrict or suspend access to an account where reasonably necessary to protect customers, prevent fraud, maintain security or respond to a material breach of these Terms. Restricting an account doesn't affect existing orders or mandatory consumer rights.

4. Products

We make reasonable efforts to describe and display our products accurately.

Colors and appearance may vary slightly depending on screen settings, materials and technically unavoidable differences between production runs. Such minor differences don't affect your statutory rights. A product that doesn't conform to its description or agreed characteristics may still be defective under applicable law.

Measurements and dimensions are approximate unless expressly stated otherwise. Customers should review size charts, dimensions, materials and product descriptions before ordering.

Products may be manufactured and fulfilled by different production partners. The identity or location of a fulfillment provider doesn't change the fact that your purchase contract is made with STARDUST PHARMACY.

We may update product descriptions, discontinue products or limit availability before an order is accepted. Changes won't affect orders that have already been accepted unless agreed with the customer or required by law.

5. Order process and contract formation

Displaying a product in our store is an invitation to place an order and isn't a legally binding offer.

By selecting products and submitting the checkout form, you make a binding offer to purchase the products shown in your order summary.

An automatically generated order confirmation acknowledges that we received your order. It doesn't necessarily mean that we have accepted the order.

A purchase contract is formed when we expressly confirm acceptance, send a shipping confirmation or dispatch the product, whichever occurs first.

We may decline an order before acceptance for legitimate reasons, including:

  • A product being unavailable

  • Payment authorization failing

  • Suspected fraud or unauthorized payment activity

  • Delivery restrictions

  • An obvious pricing or product-description error

  • Legal or regulatory restrictions

If we decline an order after receiving payment, we will refund the amount paid using the original payment method.

After a contract has been formed, an order may only be cancelled in accordance with these Terms, our Return and Refund Policy, applicable withdrawal rights or another legal right.

6. Prices, taxes and additional charges

The price charged will be the price displayed during checkout when the order is submitted.

Prices displayed to consumers include applicable value added tax where required by law. In countries where taxes are normally calculated separately, applicable taxes may be added and shown during checkout.

Delivery charges and other applicable charges will be displayed before you submit your order.

Customers ordering from outside the relevant customs or tax territory may be responsible for import duties, customs charges or local taxes where these amounts aren't collected during checkout. Where reasonably possible, such potential charges will be disclosed before purchase. We don't control charges imposed directly by customs authorities or delivery carriers.

Prices, promotions and discounts may change before an order is placed. Changes don't affect accepted orders.

Promotions may be subject to separate conditions. Unless stated otherwise, promotions can't be combined, exchanged for cash or applied retrospectively.

7. Payment

Available payment methods are displayed during checkout.

You confirm that you are authorized to use the payment method supplied. Payment providers may perform authorization, fraud-prevention and identity checks.

Payment may be authorized or collected when the order is placed. Collection of payment alone doesn't constitute acceptance of an order.

If a payment is reversed, rejected or later determined to be unauthorized, we may suspend fulfillment or take reasonable steps to recover amounts lawfully owed.

8. Production, shipping and delivery

Many products are manufactured after an order is placed. Estimated production and delivery periods may therefore include both manufacturing and shipping time.

Delivery estimates aren't guaranteed delivery dates unless we expressly agree to a binding date.

Products from the same order may be fulfilled by different providers and delivered in separate parcels. Separate tracking information may be provided for each parcel.

We aren't responsible for delays caused by circumstances outside our reasonable control, such as carrier disruption, customs processing, severe weather, strikes, natural disasters or government action. We will nevertheless comply with all mandatory obligations and inform you of material delays where reasonably possible.

Nothing in this section limits your statutory rights if products aren't delivered within an agreed or legally required period.

For consumer purchases, the risk of accidental loss or damage generally remains with us until the product is received by you or by a third party designated by you who isn't the carrier.

If you independently appoint a carrier that we didn't offer or identify, different statutory risk-transfer rules may apply.

9. Order changes and cancellations

Contact us immediately at contact@stardustpharmacy.cc if you need to change or cancel an order.

Because products may enter production shortly after ordering, we can't guarantee that a requested change or cancellation can be completed before production or dispatch.

This section doesn't restrict statutory withdrawal rights or other mandatory cancellation rights.

10. Returns, withdrawals and refunds

Returns, withdrawals, exchanges and refunds are governed by our Return and Refund Policy.

Consumers residing in the European Economic Area or United Kingdom may have a statutory right to withdraw from eligible online purchases within 14 days without providing a reason. Details of this right, applicable exceptions and the model withdrawal form are provided in our Withdrawal Information.

Except where mandatory consumer law provides otherwise, we don't offer a voluntary change-of-mind return or exchange right for customers outside the regions covered by our stated withdrawal policy.

Genuinely personalized products or products manufactured according to a customer's individual specifications may be excluded from statutory withdrawal rights where applicable law permits. A standard product featuring an existing design isn't treated as personalized merely because it is produced after ordering.

Nothing in our return policies limits statutory rights concerning damaged, defective, misprinted, missing or incorrectly supplied products.

11. Defective, damaged or incorrect products

If a product arrives damaged, defective, misprinted or different from what was ordered, contact us at contact@stardustpharmacy.cc.

Please provide your order number, a description of the issue and photographs where reasonably possible. Photographs help us investigate production and shipping problems, but an inability to provide photographs or original packaging doesn't automatically remove statutory rights.

Don't return a defective or incorrect product unless we provide return instructions.

Depending on the circumstances and applicable law, available remedies may include repair, replacement, price reduction, cancellation or refund. We will cover necessary return costs where required by law.

Statutory warranty and conformity rights remain unaffected.

12. Intellectual property

The website and its content, including artwork, photographs, graphics, logos, designs, text, audio, video, product names and layout, are owned by us or used with permission from their respective rights holders.

These materials are protected by applicable copyright, trademark and other intellectual-property laws.

You may access and use the website for personal and non-commercial purposes. You may not reproduce, distribute, sell, license, modify, publish, commercially exploit or create derivative works from protected content without permission from the relevant rights holder.

Purchasing a physical product doesn't transfer copyright or other intellectual-property rights in the artwork or design appearing on that product.

STARDUST PHARMACY, its logos and associated branding may not be used in a manner that suggests affiliation, endorsement or authorization without our written permission.

13. Reviews and submitted content

If you voluntarily submit a review, photograph, comment or other content for publication, you confirm that you have the rights needed to submit it and that it doesn't infringe the rights of another person.

You grant us a non-exclusive, worldwide, royalty-free license to store, reproduce and display the submitted content for operating and promoting the store and its products.

This license doesn't transfer ownership of your content to us.

We may moderate or remove submitted content that is unlawful, misleading, abusive, infringing, unrelated to the product or otherwise violates these Terms.

We won't alter a customer review in a way that misrepresents the customer's opinion.

14. Acceptable use

You may only use the website for lawful purposes.

You must not:

  • Attempt to gain unauthorized access to the website, accounts or connected systems

  • Introduce viruses, malicious code or other harmful material

  • Interfere with the website's security or operation

  • Use the website to commit fraud or impersonate another person

  • Collect personal information about other users without authorization

  • Infringe intellectual-property, privacy or other legal rights

  • Use automated scraping or extraction tools in a manner that disrupts the website or violates applicable law

  • Circumvent technical restrictions or security measures

We may take proportionate steps to prevent or stop unlawful, fraudulent or harmful activity.

15. Third-party services and links

Our website may use or refer to services operated by third parties, including Shopify, payment providers, fulfillment providers and social-media platforms.

Third-party services may be governed by their own terms and privacy policies. We aren't responsible for content or services provided independently by third parties.

Nothing in this section excludes responsibility that we are legally required to accept, including our responsibility as the seller of products purchased directly from STARDUST PHARMACY.

16. Relationship with Shopify

Shopify provides the ecommerce technology used to operate our store.

Purchases made through our store are made directly with STARDUST PHARMACY. Shopify isn't the seller of the products and doesn't determine our product descriptions, prices, return policies or customer-service decisions.

Shopify may process personal information and provide payment, fraud-prevention or technical services as described in our Privacy Policy and Shopify's applicable privacy notices.

Nothing in this section excludes any claim or right that can't lawfully be excluded.

17. Privacy

Our collection and use of personal information are described in our Privacy Policy.

Information may be processed by Shopify, payment providers, production partners, shipping carriers and other service providers where necessary to process orders and operate the store.

Some service providers may process information outside your country of residence. Applicable data-protection safeguards are described in our Privacy Policy.

18. Liability

We are liable without limitation:

  • For loss caused intentionally or through gross negligence

  • For injury to life, body or health caused intentionally or negligently

  • Under the German Product Liability Act and other mandatory product-liability laws

  • Where we have expressly guaranteed a product characteristic

  • In any other circumstance where liability can't legally be excluded or limited

For loss caused by ordinary negligence, we are liable where we breach a material contractual obligation whose performance is necessary for the proper performance of the contract and on which the customer may normally rely. In such cases, liability is limited to loss that was typical and reasonably foreseeable when the contract was formed.

The preceding limitations also apply to our legal representatives, employees and fulfillment providers where legally permissible.

Nothing in these Terms limits statutory rights to repair, replacement, price reduction, withdrawal, cancellation or refund.

19. Events outside reasonable control

We aren't responsible for a delay or failure caused by an event outside our reasonable control to the extent that the delay or failure couldn't reasonably have been prevented.

We will take reasonable steps to reduce the effects of such an event and resume performance when possible.

This section doesn't limit mandatory rights concerning delayed delivery, cancellation, refunds or product conformity.

20. Suspension and termination of website access

We may suspend or terminate access to website features where reasonably necessary because of unlawful activity, fraud, security risks or a material breach of these Terms.

Termination of website access doesn't cancel accepted orders, remove payment obligations already incurred or limit statutory consumer rights.

Provisions concerning intellectual property, liability, payment obligations and other provisions that by their nature should continue will survive termination.

21. Changes to these Terms

We may update these Terms to reflect changes in law, our services, technology or business operations.

Changes apply prospectively from the effective date shown in the updated Terms. Changes won't alter accepted orders or existing contractual rights unless the change is required by law or expressly agreed with the customer.

Where legally required, we will provide notice of material changes.

22. Governing law and jurisdiction

For contracts with consumers, applicable law and jurisdiction will be determined according to mandatory conflict-of-law and consumer-protection rules.

Consumers retain the mandatory protections of the country in which they habitually reside where our commercial activities are directed to that country.

For contracts with businesses, public-law entities or public-law special funds, the laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.

Where legally permitted, the courts responsible for our place of business will have jurisdiction over disputes with business customers. Statutory jurisdiction rules apply to consumers.

23. Consumer dispute resolution

We aren't obliged or willing to participate in dispute-resolution proceedings before a consumer arbitration board unless mandatory law requires otherwise.

24. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain effective.

The invalid or unenforceable provision will be replaced or interpreted only to the extent permitted by applicable law. Statutory provisions will apply where replacement or interpretation isn't legally possible.

25. No waiver

If we don't immediately enforce a contractual right, this doesn't mean that we waive that right.

A waiver is effective only where clearly communicated and legally valid.
